This Policy guarantees to the owner of a residential property in Spain that the insured property is free from unknown title defects or claims of third parties that could materialise after the purchase.
The Policy lasts as long as you are the owner of your property for a period of up to 20 years. It is a peace of mind policy everyone should have.
Here are a few instances that are covered by this Policy.
Any adverse claim by third parties. 'A mistake in the identity of any predecessor in title caused by any reason this includes undisclosed marital status or insolvency.
Inaccuracies in the documents or deeds necessary for the preparation of the Escritura.
Undocumented legal or beneficial rights of way, servitudes or easements.
Violation of any planning or building regulation by a prior owner.
Any claim from prior owners or their heirs.
Administrative procedures that could cause a partial or full failure of title.
All undiscovered mortgages, privileges or other rights of third parties.
Mistakes, errors or omissions on the part of the Notario, as well as certain matters that the Notario is not obliged to or cannot check anyway, and for which the Notario therefore does not carry insurance.
Boundary disputes An unauthorised sale of your property by a fraudulent third party.
