Spain Guides | Illegal Rental Investigation
Crackdown on Unlicensed Tourist Rentals in Spain
Spain's consumer protection agency is launching an investigation into online platforms listing tourist rentals. Their aim is to identify and remove advertisements for illegal vacation properties.
This action comes after evidence revealed a significant number of tourist homes operating without proper licenses. These platforms, like Airbnb, simply act as a middleman for listing information. However, the investigation will target the individuals responsible for advertising unlicensed rentals.
If the initial investigation uncovers signs of non-compliance, hefty fines could be issued. Penalties could reach up to €100,000 or even higher, potentially exceeding four to six times the illegal profits made depending on the scale of the activity.
Beyond financial penalties, online platforms may even face permanent shutdowns for persistent violations. "We're evaluating potential sanctions for rental listings that break regulations," stated Daniel Arribas, a consumer affairs official.
Bibiana Medialdea, another consumer affairs leader, confirmed receiving "clear evidence" of widespread non-compliance within the tourist rental market. In some regions, the percentage of unlicensed properties could be as high as 90%. Medialdea emphasized that advertising such illegal accommodations is also unlawful. Consumer Affairs will be responsible for "investigating, inspecting, and potentially sanctioning" these violations.
